The employer of a live-in caregiver in Canada is a person who hires someone to care
for his or her children, senior members of the family, or disabled persons, without
supervision. This person must live in the household of the people he/she is caring
for or in the home of the employer.
According to Canadian immigration law, “a live-in caregiver is a person who provides
child care, senior home support and care or care of the disabled without supervision
in a private household in Canada in which the person resides.”

Employers Eligibility
To qualify as an employer an employer must meet the following requirements:
- Have sufficient income to pay the carer's salary and benefits, according to
the province's rates.
- Live in Canada
- Provide a private room in the home for the carer to live in.
- The position offered must be full time.
- A positive Labour Market Opinion from Human Resources and Skills Development Canada/Service

Responsibilities of an Employer
Employers must commit to the following duties in order to qualify for a positive
labour market opinion to employ a foreign carer.
- Pay for the carer's health insurance
- Enrol the caregiver in provincial workplace safety insurance
- Pay the recruitment agency fees if one is being used.
- Pay travel costs for the carer to get to Canada
- Submit an application for a Labour Market Opinion and a contract of employment to
HRSDC/Service Canada
Employers must also:
- Keep up-to-date weekly and monthly records of the employee's work hours.
- Keep the carer’s wages at a level that meets or exceeds HRSDC's requirements
- Inspect the carer’s work permit to ensure that your name is listed as the employer
and that it is valid an up-to-date for a live in caregiver in Canada – you are not
allowed to take the permit away from the employee.
