General Information

A conjugal partner is a person who lives outside Canada and who has been in a conjugal relationship with the sponsor for at least one year.

In the sponsoring conjugal partner application, a conjugal relationship is one where there is a considerable amount of physical, emotional, social, and financial attachment between the couple.  Both partners are committed to each other in a permanent, long-term and exclusive relationship.  They share the same values and interests, they spend time together as a couple and with each other's families.   Conjugal partners socially present themselves as a couple with their friends, family, and community, and they are viewed by others as being a couple. Conjugal partners cannot have lived together due to cultural or immigration reasons.

Documents that may prove the existence of a conjugal relationship for your sponsoring conjugal partner application:

  • Photos of the couple
  • Long distance phone bills (pre-paid phone cards are usually not considered evidence)
  • Plane tickets or boarding passes for visits of one partner to the other or for trips the couple has made together
  • E-mails, letters, greeting card
  • Joint bank accounts
  • Joint credit cards
  • Money transfers
  • Insurance policies showing the partner as beneficiary
  • Declarations from family, friends or prominent members of the community (doctors, lawyers, religious workers, etc.) stating their recognition of the couple being in a conjugal relationship.


Eligibility

To be eligible for sponsoring conjugal partner, you must meet the following requirements:

  1. You are at least 18 years of age
  2. You are a Canadian citizen living in Canada or living abroad
  3. OR you are a permanent resident of Canada, living in Canada
  4. You are not receiving social assistance
  5. You are not in default of any previous sponsorship
  6. You are not bankrupt
  7. You are not in prison


Application Process

Along with the Sponsorship application and the Application for Permanent residence, the following supporting documents are required for sponsoring common-law partner:

Tax documents Photocopy of valid passport
Proof of relationship to conjugal partner Police certificate
  Proof of relationship to conjugal partner in Canada

Processing Timelines

Decisions on sponsorship applications can take from 6 to 18+ months. Completing the application accurately can speed up the process. The following are the main reasons for delays and refusals in applications:

  • You did not prove that the relationship between you and your conjugal partner is not genuine
  • The person you want to sponsor and his or her family members are inadmissible to Canada because they have a criminal record or serious illness that is contagious
  • Forms are not completed properly or forms are not signed
  • There are missing supporting documents
Average time to complete application by Immigroup: 2-4 weeks

Fees

Fees are paid in installments; last payment is due before the Sponsorship Application is submitted to CIC. If you need more time to make payments, please speak with our accounting department.

* Additional fees apply for sponsoring dependent children or if translation and courier is required.


What you can expect from us

Your application will be accurate and complete, and in accordance with Canadian Immigration law

We charge a fee of CDN $75 for this consultation. This fee will be deducted from our total fees if you retain our services.
