General Information

A spouse is a person who is at least 16 years of age and is legally married to the sponsor by the civil authorities of a country.  A marriage is valid in Canada if it is valid in the country where it took place.

A couple can prove they are legally married if they have a marriage certificate issued by the civil authorities of the country where the marriage took place. This will be needed in your application for sponsoring spouse.

Documents to prove your relationship to your spouse:

  • Marriage certificate issued by the civil authority of the country where the marriage took place.

If one of the parties was married in the past, a divorce certificate issued by a Court must be submitted with the sponsorship application.

If widowed, death certificate of former spouse must be submitted with the sponsorship application.


Eligibility

To be eligible for sponsoring a spouse, you must meet the following requirements:

  1. You are at least 18 years of age
  2. You are a Canadian citizen living in Canada or living abroad
  3. OR you are a permanent resident of Canada, living in Canada
  4. You are not receiving social assistance
  5. You are not in default of any previous sponsorship
  6. You are not bankrupt
  7. You are not in prison


Application Process

Along with the Sponsorship application and the Application for Permanent residence, the following supporting documents are required for sponsoring common-law partner:

Employment records Photocopy of valid passport
Tax documents Police certificates from all
Proof of relationship to common-law partner Countries of residence in the past 10 years
  Proof of common-law relationship to person in Canada
  Medical clearance


Processing Timelines

Decisions on sponsorship applications can take from 6 to 18+ months. Completing the application accurately can speed up the process. The following are the main reasons for delays and refusals in applications:

  • You did not prove that the relationship between you and your spouse is not genuine
  • The person you want to sponsor and his or her family members are inadmissible to Canada because they have a criminal record or serious illness that is contagious
  • Forms are not completed properly or forms are not signed
  • There are missing supporting documents
Average time to complete application by Immigroup: 2-4 weeks

Fees

Fees are paid in installments; last payment is due before the Sponsorship Application is submitted to CIC. If you need more time to make payments, please speak with our accounting department.

Right of permanent residence fee CDN $490 *

* Additional fees apply for sponsoring dependent children or if translation and courier is required.


What you can expect from us

Your application will be accurate and complete, and in accordance with Canadian Immigration law

We charge a fee of CDN $75 for this consultation. This fee will be deducted from our total fees if you retain our services.
