This page is designed to guide you through your application for sponsoring spouse.


General Information

A spouse is a person who is at least 16 years of age and is legally married to the sponsor by the civil authorities of a country.  A marriage is valid in Canada if it is valid in the country where it took place.

A couple can prove they are legally married if they have a marriage certificate issued by the civil authorities of the country where the marriage took place. This will be needed in your application for sponsoring spouse.

Documents to prove your relationship to your spouse:

  • Marriage certificate issued by the civil authority of the country where the marriage took place.

If one of the parties was married in the past, a divorce certificate issued by a Court must be submitted with the sponsorship application.

If widowed, death certificate of former spouse must be submitted with the sponsorship application.


Eligibility

To be eligible for sponsoring spouse to Canada, you must meet the following requirements:

  1. You are over 18 years of age
  2. You are a Canadian citizen living in Canada or living abroad
  3. OR you are a permanent resident of Canada, living in Canada
  4. You are not receiving any social assistance
  5. You are not in default of any previous sponsorship
  6. You are not bankrupt
  7. You are not in prison


Application Process

Along with the Sponsorship application and the Application for Permanent residence, the following supporting documents are required for sponsoring spouse:

Tax documents Photocopy of valid passport
Proof of genuine relationship to spouse Police certificate

Processing Timelines:

Decisions on sponsorship applications for sponsoring spouse can take from 6 to 18 months. Completing the application accurately can avoid delays to the process. The following are the main reasons for delays and refusals in applications:

  • You did not prove that the relationship between you and your spouse is genuine
  • You do not meet the financial requirements
  • The person you want to sponsor and his or her family members are inadmissible to Canada because they have a criminal record or they constitute a danger to Canada’s public health or safety.
  • Forms are not completed accurately or forms are not signed
  • There are missing supporting documents

* Additional fees apply if dependents are included with the application as accompanying or if translation and courier is required
