About Spousal Sponsorship

Citizenship and Immigration Canada classifies a spouse as a marriage partner aged at least 16 years who has legally married a Canadian citizen or permanent resident. The international marriage has to be legally accepted by the civil powers in the country where the marriage took place. Note that a foreign wedding ceremony does not signify an officially authorized marriage if it has not been registered correctly with the civil authorities in the country where the marriage took place. Under Canadian law, only a valid Marriage Certificate can confirm that your international marriage is legal in Canada. Under the spousal sponsorship initiative, Canadian citizens and permanent residents can also bring over their common-law partner, same sex partner, conjugal partner and their foreign spouse’s dependent children.

Documents Required

The basic documents required for proving the relationship between you and your foreign partner is genuine are as follows:

  • Marriage certificate from the civil authority of the country where the marriage took or will take place.
  • Proof of a genuine relationship both ways. This includes letters, postmarked envelopes, copies of emails and of records of online conversations, greeting cards, phone bills (not pre-paid cards), photos, copy of plane tickets and boarding passes, passports with entry and exit stamps from the country where your foreign spouse resides, money transfers.

Process

The process of spousal sponsorship for permanent residence in Canada has two different aspects:

  1. The spousal sponsor submits a sponsorship to Citizenship & Immigration Canada on behalf of his or her foreign spouse who lives abroad for residing in Canada.
  2. The foreign spouse residing abroad completes an application for permanent residence in Canada.
