Marriage to an Austrian Citizen

Every country has its own laws that apply to its citizens marrying a person from a different country. Getting married to an Austrian citizen with the goal of eventually bringing them to Canada to live is a process with many steps.

You must demonstrate to Austrian officials that they are not currently married to anyone else – either you have never been married or all divorces are finalized – that your identity is proven and that you have never committed any crimes in Austria. This is done by providing various documents, including an Affidavit of Single Status to the Austrian government either in Austria or via an Austrian embassy.

If you want to bring your Austrian spouse or partner to live in Canada, you must then file a sponsorship application for them to become a permanent resident. Austrian Marriage Basic Requirements

Couples planning to get married in Austria should be happy to know that civil marriages are legal in Austria and they can be done at the vital statistics office.

The legal marrying age in Austria is 18 years but persons who are 16 years can marry with a written and notarized consent from parents if the other spouse is 18 years old.

The ceremony is conducted by an official Austrian interpreter at the couple’s expense unless they speak German.

The requirements to get the visa are:

  • Passport
  • Birth certificate
  • Certificate of residence, driver’s license or latest tax slip
  • Proof of divorce is divorced or death certificate if widowed
  • Other documents other than the passport not in German should be translated.

 

Austrian Marriage Ceremony

The marriage ceremony to an Austrian citizen can legally take place in Austria, Canada, or any other country as long as both parties have the necessary visas to enter this country legally. Family Members

If your Austrian spouse has dependent children, this does not affect the Austrian Marriage document application.

If you have dependent children, they have no effect on the application to marry an Austrian citizen.

How long is the Austrian Marriage document valid?

The document is valid for 6 months from the date of issue. If you do not marry your Austrian fiancé within 6 months of the issuance of the Austrian Marriage document, you must apply again with new supporting documents.
