Human Resources and Skills Development Canada Labour Market Opinion
In most cases, a work permit is required to work temporarily in Canada. To obtain one, you must have a job offer from a Canadian employer validated by Human Resources and Skills Development Canada HRSDC. However, certain occupations do not require HRSDC validation. In some cases, temporary workers do not require a work permit but do require a Temporary Resident Visa (TRV). Before you can apply for your Canadian work permit, your Canadian employer must file an application for a Labour Market Opinion with Human Resources and Skills Development Canada. HRDSC takes the following points into consideration when issuing positive Labour Market Opinions:
- The job that the foreign worker will undertake
- the work conditions and wages offered
- the employer's record of advertising and recruiting a worker from inside of Canada
- the benefits brought to the Canadian labour market through the employment of a foreign worker
- the discussion, if necessary, with any unions
- whether employing a foreign worker will affect the resolution of a labour dispute
