US asylum case referred to court, can i head to Canadian boarders to seek asylum

Dear all

My asylum case got denied in US and referred to court and cannot go back to home country as I fear persecution. Can I request asylum at the Canadian boarders?

You can try. One of two things will happen:
  • you will be turned away due to the "safe third country agreement" (meaning you are already in a safe country other than Canada)
  • you will be allowed to file an asylum claim.
There was a period when a lot of people were allowed to file asylum claims from the US when previously they weren't. But that period corresponded with a different US president. I don't know if the policy has reverted back to the historical norm.
